Terms of Service
These terms govern your use of the Swelly and Flute Discord bots, our website, and any premium services. By inviting a bot or purchasing premium, you accept these terms.
1. Eligibility
You must meet Discord's minimum age requirement for your region and comply with the Discord Terms of Service and Community Guidelines. You must have permission to add bots to any server where you invite Swelly.
2. Acceptable use
You agree not to:
- Abuse, spam or attempt to overload the bot or our infrastructure.
- Reverse engineer, scrape or attempt unauthorised access to our services.
- Use Swelly to distribute infringing, illegal or harmful content.
- Resell, sublicense or redistribute premium entitlements.
- Circumvent rate limits, premium checks or region restrictions.
3. Content and third-party sources
Swelly streams audio from third-party platforms. We do not host, own or control that content, and availability may change without notice. You are responsible for ensuring your use of any content complies with the source platform's terms and applicable law.
4. Premium subscriptions
Premium tiers are billed through Patreon on a recurring monthly or yearly basis until cancelled. Yearly plans are discounted as shown at checkout. Entitlements activate on your Discord account and can be applied to the number of servers included in your tier. Cancelling stops future charges; access continues to the end of the paid period.
5. Refunds
Because premium unlocks immediately, payments are generally non-refundable. We will review refund requests made within 7 days of purchase where premium features were materially unavailable. Donations are always non-refundable.
6. Availability
We aim for high uptime but provide the service “as is” and “as available”, without guarantees of uninterrupted operation. Maintenance, Discord outages or third-party changes may temporarily affect functionality.
7. Termination
We may suspend or terminate access to Swelly, with or without notice, for breach of these terms, abuse of the service, or where required by law or by Discord. You may stop using Swelly at any time by removing it from your servers.
8. Limitation of liability
To the maximum extent permitted by law, Swelly and its maintainers are not liable for indirect, incidental or consequential damages, loss of data, or loss of profits arising from use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
9. Changes and contact
We may update these terms; continued use after changes take effect constitutes acceptance. Questions can be raised in our support server.
